Plain terms for a free program.

Who you are agreeing with

Ham Email is published by Andrei Ivanoff (KO4ZHL), an individual trading as Ham Email, 1535 Canal Street, New Orleans, Louisiana 70112, United States. “We” and “us” below mean that person. By installing or using Ham Email you agree to these terms.

Your license

Ham Email is free to download and free to use, for personal use and for the use of a club or a group station. You may install it on as many computers as you operate. You may not sell it, charge for it, or redistribute a modified copy as though it were ours.

The software contains open-source components under their own licenses, which continue to govern those components — see Credits & Licenses. Nothing here limits any right those licenses give you.

Your mail and your mailbox

Your mail is yours and stays on your computer and with your provider; we never hold a copy. You are responsible for keeping your passwords to yourself and for what is sent from your accounts. Your mail provider has terms of its own, and using it through Ham Email does not change them.

A callsign address is provided by QSL World under QSL World’s terms and plan; Ham Email is a client for it, not the provider of it.

Sending mail

Everything sent from Ham Email is sent under your name, your address and your responsibility. Do not use it to send bulk unsolicited mail or to impersonate another operator.

Third-party services

Your mail provider, Gravatar, QSL World and your own AI provider are run by other people under their own terms. We connect to them on your behalf; we do not control them and cannot promise they will be available or correct.

No warranty

Ham Email is provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted, error-free, or that any message will be delivered, received or kept.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, nor for lost mail, missed messages or anything sent by mistake, arising from the use of or inability to use the software. Where liability cannot be excluded, it is limited to the amount you paid for the software, which is nothing.

Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as the law allows, and nothing here affects rights you have as a consumer that cannot be waived.

Changes

These terms may change; the date at the top changes with them. Continuing to use the software after a change means accepting it. The software itself changes too, and features may be added or withdrawn.

Governing law

These terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict of law rules.
